There has been a continuing increase in OPDU members adopting the Court Application Costs extension which is optional cover for when the trustees are advised to seek directions or a declaration from the court as to the future conduct of matters or the interpretation of trust documents.
It is usual for interested parties to be represented by separate lawyers and all costs have to be met out of the pension scheme’s assets which are covered by this extension.
